A partir do m\u00eas de outubro, as escolas particulares estipulam per\u00edodos de renova\u00e7\u00e3o ou reserva de matr\u00edcula. O Procon, \u00f3rg\u00e3o vinculado \u00e0 Secretaria Municipal de Desenvolvimento Econ\u00f4mico, da Prefeitura de Adamantina, orienta sobre alguns cuidados.<\/p>\n

\n

\u00a0Os estabelecimentos de ensino particulares normalmente cobram taxas para a reserva de vaga. O consumidor, neste caso, precisa estar atento ao prazo estabelecido pela institui\u00e7\u00e3o para desist\u00eancia da reserva, com devolu\u00e7\u00e3o de eventuais valores pagos.<\/p>\n

A recomenda\u00e7\u00e3o \u00e9 que se estabele\u00e7a, por escrito com a escola, como ser\u00e1 dada a restitui\u00e7\u00e3o.<\/p>\n

A escola deve divulgar a proposta de contrato, o valor da anuidade e o n\u00famero de vagas por sala, em um per\u00edodo m\u00ednimo de 45 dias antes da data final da matr\u00edcula.<\/p>\n

\n

Todo contrato deve ter linguagem clara e simples e nele constar os direitos e deveres entre as partes. O contrato precisa ser lido com muita aten\u00e7\u00e3o; acordos verbais podem esconder armadilhas, por isso, \u00e9 importante que sejam firmados por escrito.<\/p>\n

\n

As escolas t\u00eam obriga\u00e7\u00e3o de fornecer a lista de material aos alunos, para que os pais possam pesquisar pre\u00e7os e escolher o fornecedor de sua prefer\u00eancia. Algumas exigem que o material seja comprado no pr\u00f3prio estabelecimento, mas esta pr\u00e1tica \u00e9 abusiva.<\/p>\n

\n

Os pedidos de hist\u00f3rico escolar para transfer\u00eancia devem ser formalizados por escrito e protocolados junto ao estabelecimento. Podem tamb\u00e9m ser encaminhados pelo correio com aviso de recebimento (AR), anotando-se nele o teor da correspond\u00eancia.<\/p>\n

\u00c9 indicado ainda verificar se \u00e9 obrigat\u00f3rio o uso de uniforme escolar. Caso seja positivo, se o custo do mesmo ir\u00e1 influenciar no or\u00e7amento final.<\/p>\n

Por isso, fique atento, pois somente se a institui\u00e7\u00e3o educacional possuir uma marca devidamente registrada, poder\u00e1 estabelecer que a compra seja feita na pr\u00f3pria escola e\/ou em terceiros pr\u00e9-determinados.<\/p>\n

Quando for o caso, verificar se h\u00e1 descontos para irm\u00e3os e se a escola \u00e9 servida por transporte escolar legalmente cadastrado.<\/p>\n

REAJUSTE \u2013\u00a0<\/strong>O valor total da anuidade escolar \u00e9 regulamentado pela Lei Federal 9.870\/99. A legisla\u00e7\u00e3o permite que seja acrescido ao valor total da anuidade ou semestralidade anterior, montante proporcional a varia\u00e7\u00e3o de custos a t\u00edtulo de pessoal e de custeio, comprovado mediante apresenta\u00e7\u00e3o de planilha de custo, mesmo quando esta varia\u00e7\u00e3o resulte da introdu\u00e7\u00e3o de aprimoramentos no processo did\u00e1tico-pedag\u00f3gico.<\/p>\n

A Secretaria de Direito Econ\u00f4mico do Minist\u00e9rio da Justi\u00e7a poder\u00e1 requerer comprova\u00e7\u00e3o documental de qualquer cl\u00e1usula contratual.<\/p>\n
