A pena foi fixada em 2 anos, 4 meses e 24 dias de reclus\u00e3o, sendo a privativa de liberdade convertida em presta\u00e7\u00e3o de servi\u00e7os \u00e0 comunidade e presta\u00e7\u00e3o pecuni\u00e1ria.<\/div>\n<div>Os fatos aconteceram na Comarca de Adamantina, entre janeiro e fevereiro de 2021. Segundo os autos, o r\u00e9u realizou a cirurgia em pelo menos tr\u00eas animais. Al\u00e9m disso, foram encontradas em seu celular imagens de outros c\u00e3es mutilados e di\u00e1logos com terceiros a respeito do procedimento, o que, no entendimento do desembargador Pinheiro Franco, relator do ac\u00f3rd\u00e3o, indica que o acusado \u201cexercia a atividade il\u00edcita de forma habitual\u201d.<\/div>\n<div>No recurso, a defesa n\u00e3o se insurgia contra a condena\u00e7\u00e3o, mas buscava altera\u00e7\u00e3o na pena, com alega\u00e7\u00e3o de atenuantes e mudan\u00e7a na forma de fixa\u00e7\u00e3o. Foi acolhida a atenuante de baixo grau de instru\u00e7\u00e3o e modificada a fra\u00e7\u00e3o da continuidade delitiva. A conchectomia configura crime e o delito integra o rol de pr\u00e1ticas coibidas pelo artigo 32 da Lei de Crimes Ambientais, que trata sobre abusos, maus-tratos e mutila\u00e7\u00e3o de animais dom\u00e9sticos e silvestres.<\/div>\n<div>Completaram a turma julgadora Trist\u00e3o Ribeiro e Geraldo Wohlers.
