Os requerentes tamb\u00e9m cobravam o ressarcimento de despesas extraordin\u00e1rias de obras realizadas no condom\u00ednio.<\/div>\n<div>O relator do recurso, desembargador Fl\u00e1vio Abramovici, apontou em seu voto que os autores comprovaram todos os requisitos previstos na lei e que foi \u201cdescabida a recusa dos Requeridos ao recebimento das chaves, pois inexiste previs\u00e3o legal de manuten\u00e7\u00e3o da rela\u00e7\u00e3o contratual ap\u00f3s o pedido de rescis\u00e3o por parte do locat\u00e1rio\u201d, fazendo com que o pedido de consigna\u00e7\u00e3o das chaves seja legitimo. O julgador tamb\u00e9m destacou que \u201ca eventual necessidade de realiza\u00e7\u00e3o de reparos no im\u00f3vel n\u00e3o altera o deslinde do feito, pois n\u00e3o \u00e9 l\u00edcito ao locador exigir a perman\u00eancia do v\u00ednculo locat\u00edcio at\u00e9 a realiza\u00e7\u00e3o dos reparos no im\u00f3vel\u201d. O magistrado considerou a data de encerramento do contrato o dia da consigna\u00e7\u00e3o das chaves, sendo que n\u00e3o \u00e9 cab\u00edvel qualquer cobran\u00e7a ap\u00f3s o feito, al\u00e9m de considerar v\u00e1lida a restitui\u00e7\u00e3o de valores cobrados a t\u00edtulo do fundo de obras.<\/div>\n<div>Tamb\u00e9m participaram da decis\u00e3o os desembargadores Mour\u00e3o Neto e Gilson Delgado Miranda.
